Pursuant to Article 13 of EU Regulation 2016/679 of 27/04/2016

Data Controller and Processor

Purpose of Data Processing

The personal data you provide will be processed exclusively for the following purposes:

1. the execution of contracts and all related activities, including but not limited to invoicing, credit protection, administrative, managerial, organizational, and operational services necessary for contract execution;

2. compliance with legal obligations, regulations, applicable legislation, and instructions issued by legally authorized authorities and supervisory bodies.
   Processing for the above purposes does not require your explicit consent (Art. 24, letters a) and b) of the Italian Privacy Code and Art. 6, letters b) and e) of the GDPR).

Mandatory Nature of Data Provision and Consequences of Refusal

The data required for the purposes outlined in points a) and b) must be provided to fulfill legal obligations and/or to establish and execute the contractual relationship and deliver the requested services. Therefore, consent is not applicable, and refusal to provide such data would make it impossible to initiate or manage the relationship and provide the requested service.

Data Processing Methods

Personal data will be processed using the operations defined in Art. 4, no. 2) of the GDPR, for the purposes mentioned above, on paper and electronically, using automated tools, in compliance with current legislation, particularly regarding confidentiality and security, and in accordance with principles of fairness, lawfulness, transparency, and protection of the data subject’s rights.
Processing is carried out directly by the Data Controller’s organization, its processors, and/or authorized personnel.

Data Communication and Disclosure

Your personal data may be communicated, within the limits strictly relevant to the obligations, tasks, and purposes mentioned above and in compliance with applicable legislation, to the following categories of recipients:

1. entities to whom communication is required to fulfill or enforce specific legal, regulatory, or EU obligations;

2. companies within the Controller’s group, including parent, subsidiary, or affiliated companies as defined by Art. 2359 of the Italian Civil Code, acting as data processors or for administrative and accounting purposes (related to internal organizational, administrative, financial, and accounting activities, particularly those necessary to fulfill contractual and pre-contractual obligations);

3. external individuals and/or legal entities providing services instrumental to the Controller’s activities for the purposes outlined above (e.g., call centers, suppliers, consultants, companies, entities, professional firms). These entities will act as data processors.
   Personal data will not be disclosed under any circumstances.

Data Retention Period

Personal data will be retained for the entire duration of the contract entered into with the Controller. Once the contract ends, data will be retained for the period required by law for administrative documentation, after which it will be deleted.

Data Transfer

Personal data is stored on servers located within the European Union. However, if necessary, the Controller reserves the right to relocate servers outside the EU. In such cases, the Controller guarantees that any data transfer outside the EU will comply with applicable legal provisions, including the adoption of standard contractual clauses approved by the European Commission.

Data Subject Rights

As a data subject, you have the rights set out in Article 15 of the GDPR, including:

1. confirmation of whether personal data concerning you exists, even if not yet recorded, and communication of such data in an intelligible form;

2. information regarding:

   1. the origin of the personal data;

   2. the purposes and methods of processing;

   3. the logic applied in case of processing carried out with electronic tools;

   4. the identification details of the Controller, processors, and designated representatives pursuant to Art. 3, paragraph 1, GDPR;

   5. the entities or categories of entities to whom personal data may be communicated or who may become aware of it as designated representatives, processors, or authorized personnel;

  3. the right to:

1. request the updating, correction, or, where relevant, integration of data;

2. request the deletion, anonymization, or blocking of data processed unlawfully, including data that does not need to be retained for the purposes for which it was collected or subsequently processed;

3. obtain confirmation that the operations referred to in letters a) and b) have been notified, including their content, to those to whom the data was communicated, unless this proves impossible or involves a disproportionate effort compared to the protected right.
